Bucharest, January 3, 2024# rbj (Source: Agerpres) – The law ratifying the Agreement between Romania and the US regarding the mutual recognition of work periods and the right to pension was promulgated, the Ministry of Labor and Social Solidarity announced on Wednesday , on the Facebook page.

“Based on the Agreement, it will be possible to capitalize on the periods worked both in Romania and in the USA, in order to open the pension right on the principle of totalization, with the proportional granting of the pension by each state. The normative act also contains provisions regarding the collection of pensions in the state chosen by the beneficiaries. This is an important advantage for facilitating the mobility of pensioners from the two states on the territory of the other state and maintaining their access to pension rights in payment”, the announcement posted on the social network states.

Also, according to the cited source, the agreement provides provisions regarding the avoidance of a worker’s double social insurance contribution or the risk that he will not be subject to any social insurance scheme from those covered by the Agreement.

Regarding posted workers, it was also established that they are mutually exempted from paying social health insurance contributions from the national system of the state where they are posted.

The agreement in the field of social security covers persons who are or were subject to the laws of one or both states, but also those whose rights derive, according to the applicable laws, from them.

The document applies, for Romania, to the laws that regulate pensions and death benefits from the public pension system, as well as to the laws that regulate social health insurance contributions, the representatives of the ministry emphasize.
